Terms and Conditions
These Terms and Conditions ("Terms") govern the sale of products by Melt Me Sweetly (ABN 38 439 727 568)
("we", "us", or "our") through our website www.meltmesweetly.com.au (“Site”). By placing an order with us, you
agree to these Terms.
Sale
1. By placing an order, you warrant that:
(a) you are at least 18 years of age or have the consent of a parent or legal guardian;
(b) you have the legal capacity to enter into a binding contract; and
(c) the information you provide is accurate and complete.
2. We make every reasonable effort to ensure that product descriptions, images, specifications and
pricing are accurate.
However:
(a) product colours may vary due to screen settings;
(b) packaging may differ from images displayed;
(c) specifications may change where required by manufacturers; and
(d) minor variations do not constitute a defect.
We reserve the right to discontinue products at any time.
3. All prices are shown in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless otherwise stated. Shipping is calculated at checkout based on your selected delivery method:
- Standard shipping: $12.95
- Express shipping: $17.95
- Free standard shipping on orders over $120 AUD
- Free local delivery to selected Shepparton postcodes
While we endeavour to ensure pricing accuracy, we reserve the right to correct genuine pricing errors before accepting an order.
4. Payment must be made in full before dispatch unless otherwise agreed. Payments are processed
using secure third-party payment providers. We do not store complete payment card details.
5. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other
reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or
replaced if the goods fail to be of acceptable quality and the failure does not amount to a major
failure. Nothing in these Terms excludes, restricts or modifies any rights you have under the
Australian Consumer Law.
6. Promotional offers and discount codes:
(a) are available only during the advertised period;
(b) may not be combined unless expressly stated;
(c) are subject to any additional promotional terms; and
(d) may be withdrawn or amended before use.
1.7 Gift cards:
(a) are not redeemable for cash except where required by law;
(b) may have expiry dates in accordance with applicable Australian legislation;
(c) are treated as cash and may not be replaced if lost or stolen unless required by law.
8. We collect and use personal information in accordance with our Privacy Policy and the Privacy Act
1988 (Cth). By placing an order, you consent to that collection and use.
9. We are not responsible for delays or failure to perform obligations due to events beyond our
reasonable control, including natural disasters, pandemics, strikes, transport disruptions,
government actions or supplier failures.
10. These Terms are governed by the laws of Victoria, Australia and the laws of the Commonwealth of
Australia. The parties submit to the non-exclusive jurisdiction of the Australian courts.
11. We retain all intellectual property rights in or to any products and/or services and nothing in the
Terms shall have the effect of granting or transferring to you any intellectual property rights in or to
any products and/or services.
12. The Terms are subject to change at our sole discretion. Current Terms are displayed on the Site.
You should review these Terms each time you make a purchase.
13. To the maximum extent permitted by law, our liability for any claim relating to products purchased
from us is limited to the remedies available under the Australian Consumer Law. Nothing in these
Terms excludes liability that cannot legally be excluded. We are not liable for indirect or
consequential loss except where liability cannot lawfully be excluded.
